Heard Mr. Kulkarni learned counsel appearing for the Petitioner, Mr. N.V. Bandiwadekar, learned Senior Counsel appearing for Respondent No.1 and Mr. Sawant, learned AGP for Respondent Nos. 4 and 5-State.

The impugned order in the present Writ Petition is dated 9th December 2022 passed by the learned School Tribunal, Solapur below Exhibit 5 in Appeal No. 13 of 2022. As the said interim 1/2

28 WP 5630.23.doc order is in operation for about 11 months, Mr. Kulkarni, learned Counsel appearing for the Petitioner states that the said Appeal No. 13 of 2022 pending before the learned School Tribunal, Solapur be directed to be disposed of expeditiously. He states that the Appellant has concluded his arguments and the matter is kept for arguments of the Petitioner-Management on 9th November 2023. Accordingly, interference in the impugned order dated 9th December 2022 is not warranted. It is clarified that as the impugned order is only an interim order, the said Appeal be disposed of without being influenced by the observations made in the said order.

The learned Presiding Officer, School Tribunal is requested to dispose of Appeal No.13 of 2022 on or before 31st December 2023.

It is further clarified that this Court has not considered the merits of the matter and all contentions of the parties are kept open.

The Writ Petition is disposed of in above terms with no order as to costs.
