Learned Counsel for the petitioner submits that inspite of order passed by this Court dated 07th April 2016 in Writ Petition No. 2351 of 2015 (Coram : Ranjit More & Dr.Shalini Phansalkar-Joshi, JJ.), the Corporation is not permitting to allow the petitioner to construct and proceed with the development activity on the subject plot. It is further submitted that these plans were sanctioned by the Corporation. 1/2

Learned Counsel for the Corporation, on instructions, submits that in 30 to 40 cases, the Mayor received complaints that earlier some plans were sanctioned contrary to law. The Corporation is looking into such matters. Learned Counsel submits that the petitioner would be heard by the Designated Officer and a decision will be taken within stipulated time.

Without expressing any opinion on merits, we direct that the petitioner shall be heard by the concerned Officer on Friday- 31/03/2017 at 11.00 a.m. and a decision shall be reached by the Officer concerned within 2 weeks thereafter from Friday - 31/03/2017 on its own merits. The decision shall be intimated to the petitioner. All issues on merits are kept open. 4.

Writ Petition is disposed of.
