Mr. Mokashi, learned Advocate for the Petitioner would inform the Court that original Regular Civil Suit No.1 of 2009 has been decreed. Since the present Writ Petition arises out of interlocutory orders passed in the suit and thereafter by Appeal Court, the Writ Petition does not survive.

Mr. Mokashi further informs the Court that Appeal against the decree passed in the suit has also been dismissed. The same is noted by the Court.

In view of the above, Writ Petition No.825 of 2010 stands dismissed as withdrawn.
