Learned counsel for the petitioner seeks leave to withdraw the petition, with liberty to pursue his Exhibit 5 application before the trial Court. He requests that the trial Court be directed to decide the said Application (Exhibit 5) expeditiously, uninfluenced by the impugned order dated 6th December 2019.

Learned counsel appearing for the respondent No. 2 has no objection, if the hearing of Exhibit 5 application is expedited. He states that even respondent No. 3 has filed his reply in the said proceedings on 10th SQ Pathan 1/2

wp.1286.20.15.doc January 2020. Learned counsel for the respondent No. 2 tenders a copy of the Roznama. The same is taken on record.

Petition is accordingly disposed of as withdrawn. The Exhibit 5 application filed by the petitioner to be decided by the trial Court, as expeditiously as possible and in any event, within two weeks from the receipt of this order, uninfluenced by the order dated 6th December 2019. It is made clear that this Court has not considered the aforesaid petition on merits and as such, all contentions of all parties are kept open. REVATI MOHITE DERE, J.
