After this petition was heard for sometime, learned Counsel for the petitioner seeks leave to withdraw this petition with liberty to raise all the contentions during the course of evidence in the adjudication of the suit. 2.

Writ petition is accordingly allowed to be withdrawn with liberty as prayed for. Dismissed as withdrawn. All contentions of the parties on merits of the matter are expressly kept open. 3.

Civil application does not survive in view of disposal of the writ petition. It is accordingly disposed of.
