By this petition filed under Article 226 of the Constitution of India, the petitioner is seeking directions against the respondent no.3Education Officer to consider the proposal and grant approval to the appointment of the petitioner as clerk w.e.f. 1st June, 2012 and to release grant-in-aid for payment of salary to the petitioner with all consequential benefits.

The Management submitted a proposal dated 20th January, 2014 for approval to the appointment of the petitioner as clerk w.e.f. 1st June, 2012. The said proposal is not yet considered by the respondent no.3Education Officer. 5.

Learned AGP appearing for the respondent nos. 1 to 3 on instruction states that the proposal dated 20th January, 2014 shall be considered within a period of eight weeks from today. Statement is accepted.

The respondent no.3-Education Officer shall take decision on the proposal dated 20th January, 2014 submitted by the Management for appointment of the petitioner as clerk w.e.f. 1st June, 2012 within a period of eight weeks from today. The said decision would be communicated to the petitioner as well as to the Management within a period of one week from the date of passing of decision. 7.

Writ Petition is disposed of in aforesaid terms. Rule is made absolute accordingly. There shall be no order as to costs. [R. I. CHAGLA, J.] [R. D. DHANUKA, J.]
