The applicant is arrested on 28th August, 2020 in connection with C.R. No. 962 of 2020 registered with Borivali Police Station, Mumbai for offences under Sections 420, 465, 468, 471 & 120-B of Indian Penal Code (for short "IPC"). 2.
The case of the prosecution is that on 27th August, 2020, the applicant and the co-accused had visited the office of complainant for obtaining Sim card. The employees of the Airtel Company found discrepancies in documents submitted by the accused. Intimation was given to the concerned Police Station. Police arrived at the spot and it was found that the applicant and co-
accused were in possession of false documents such as Aadhar Card, Voter ID card, Pan Card. The applicant and the co-accused were immediately arrested and since then the applicant is in custody. During the course of investigation one more person was arrested. It is the case of the prosecution that the third person was involved in fabricating the documents.

Learned counsel for the applicant submits that the documents were not misused by the applicant. He is not involved in fabricating documents. There are no criminal antecedents against the applicant. He is in custody since last 8 months. 4.
Learned APP submitted that the applicant and coaccused were involved in preparing false documents such as Aadhar Card, Pan Card, Voter ID Card etc. Such documents could be used for commission of any offence. Intimation of offence was given to various Police Station to find out whether the documents are utilized by the accused in commission of any other offence. Report is awaited.

It is pertinent to note that the applicant was arrested on the spot. Documents were recovered from his custody. Search of the residential premises was conducted. No other documents were found in possession of the applicant. The offences are triable by the
magistrate. The applicant is not having any criminal antecedents. He is in custody for a period of about 8 months. Considering these circumstances, bail can be granted on certain terms and conditions. Hence, I pass the following order:
ORDER
(i) Criminal Bail Application No.458 of 2021 is allowed; (ii) The applicant is directed to be released on bail in connection with C.R. No. 962 of 2020 registered with Borivali Police Station, Mumbai on executing P.R. Bond in the sum of Rs.25,000/- with one or more sureties in the like amount; (iii) The applicant shall report concerned Police Station once in three months on first Saturday of the month between 11:00 a.m. to 1:00 p.m. till further order;
(iv) The applicant is permitted to furnish provisional cash bail security in the sum of Rs.25,000/- for a period of eight weeks in lieu of surety.
(v) Application stands disposed of accordingly.
