Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, we are satisfied that the Applicant has made out a case for allowing the present Civil Application. Hence, following order:

a) Order dated 4.1.2018 passed by this court is recalled.

b) Family Court Appeal No.28 of 2010 is restored on file for hearing .

c) Civil application stands disposed off accordingly.

d) Registry is directed to place the matter in weekly board commencing from 20.2.2018 for final hearing along with connected Family Court Appeal No.140 of 2011.
