This is an Application for bringing the legal heirs of the original Applicant Ravindra Mohite on record. The original Applicant had filed Interim Application No. 4378 of 20222 in Criminal Anticipatory Bail Application No. 303 of 2022 for cancellation of the anticipatory bail granted to the original

accused. During pendency of the Application, the original Applicant has passed away. He was the first informant in C.R. No. 202 of 2021 registered with Samarth Police Station, Pune against the original accused i.e. Respondent Nos. 2 to 4 under Sections 406, 420, 423, 465, 467, 474, 504 and 506 of the Indian Penal Code.

The contention of the Applicants is that the original accused have not given effect to the consent terms based on which the anticipatory bail was granted to them.

This is an Application only to bring legal heirs of the original Applicant on record. Considering this situation, I am inclined to allow the Application. Hence the following order.

ORDER

(i) The Applicants are permitted to pursue the Interim Application No. 4378 of 2022 in their capacity as legal heirs of the original Applicant Ravindra Mohite.

(ii) Learned counsel for the Applicant is permitted to carry out amendment in the title of the Interim Application No. 4378 of 2022.

(iii) It shall be done within a period of 3 weeks from today.

(iv) Interim Application No. 4378 of 2022 in ABA No. 303 of 2022 be listed on board on 16/04/2024. 4.

Interim Application No. 253 of 2024 stands disposed of accordingly.
