DATED : 23rd MARCH 2023 P.C:- On expressing my disinclination to entertain an application u/s.227 of Cr.P.C, in the wake of the well settled position, which is placed before me through the decision of the Apex Court in P. Vijayan Vs. State of Kerala, 2010(2) SCC 389, the learned counsel seek permission to withdraw the application. Learned counsel would however submit that he is going through great difficulties on account of the pending trial which should be expedited.

The innocuous prayer for expediting Sessions Case No.96/2016 deserve a consideration as the trial must be now ripe Tilak

2/2 20 WP 1026-21.doc for its commencement, or it might even being commenced, if not, Sessions Court, Greater Mumbai who is seized of Sessions Case No.96/2016, shall expedite the proceedings of the trial, considering the fact that the case is of the year 2016. Mr.Ajinkya Udane, Who has been appointed through legal aid to represent the respondent no.2, deserve an appreciation for his effective assistance to the Court. The Legal Services Authority shall make payment of his remuneration due and payable within a period of six weeks from today.
