This petition challenges an order dated 17 August 2016 passed by the Labour Court at Thane in an application under Section 33C(2) of the Industrial Disputes Act.

After the matter is heard at some length, it is agreed between learned Counsel representing the parties that the petition can be disposed of by modifying the order by deducting the element of bonus in the sum of Rs.38,485/- from the amount ordered to be paid by the court. Accordingly, the petition is disposed of by modifying the directions and directing the Petitioner herein to pay to the Respondent (original Applicant) total amount of Rs.60,000/-towards unpaid salary and leave encashment along with interest at the rate of 12% per annum from 1 / 2

sat wp 4345-2017.doc the date of application till its realization. This amount shall be in full and final settlement of the Respondent's claim against the Petitioner herein towards unpaid dues. The amount shall be paid by the Petitioner to the Respondent within four weeks from today.
