Heard Mr. Rohit Jadhav i/b. NDB Law, learned counsel for the Applicant / Appellant and Ms. Pranali Railkar i/b. Mr. Vilas Tapkir, learned counsel for the Respondent No.1. Respondent No.2 though duly served with notice, remained absent as per service affidavit filed by the Applicant - Insurance Company. 3.

There seems to be delay of 1 year and 328 days in preferring the Appeal. Ms. Pranali Railkar holding for Mr. Vilas Tapkir, learned counsel for the Respondent No.1 has no objection to condone the delay in view of nature of dispute. As such, there is no hurdle to allow this Application.

ORDER

(i) The Application for condonation of delay is hereby allowed.

(ii) The Registry is directed to make scrutiny of the appeal as per procedure and thereafter it be numbered and place the matter before appropriate Court. (iii) The Interim Application is accordingly disposed of.
