By this Petition the Petitioner herein has challenged the order dated 20.12.2016 whereby the learned Judge Family Court, Mumbai, has dismissed the Application for restoration of Petition No.1754 of 2010. The said application was dismissed mainly on the ground that the Petitioner had not filed any application for condonation of delay. With consent, the impugned order is set aside with liberty to the Petitioner to file an application for condonation of delay. The learned Judge, Family Court, shall decide the application for condonation of delay as well as restoration application on its own merits. All points and contentions are kept open.
