Heard Ld. Counsels for the parties.

Ld. Counsel who appear on behalf of all the respondents, on the basis of instructions from the respondents, states that the impugned order dated 9/9/2017 may be set aside and the Regular Civil Suit No.217/14 may be restored to the file of Ld. Trial Judge and also the suit may be ordered to be expeditiously disposed of, since the petitioner is the only contesting party.

Accordingly, the impugned order dated 9/9/2017 is set aside. Regular Civil Suit No.217/14 is restored to the file of Ld. Trial Mamta Kale

20-cwp-1602-18 Judge and the Ld. Trial Judge is directed to dispose of the same, as expeditiously as possible, and in any case on or before 31/12/2019. All parties to co-operate with the Ld. Trial Judge in the matter of expeditious disposal and not to take unnecessary further adjournments in the matter. This is observed because, it is pointed out that the petitioner is not at all regular in attending the proceeding before the Court.

The petition is disposed of with aforesaid terms. 5.

All concerned to act on the basis of an authenticated copy of this order.
