This is an application for bail in CR No.36 of 2018 registered with Powai Police Station for offences under Sections 326, 324, 143, 145, 147, 148, 149 r/w Section 34 of Indian Penal Code. The FIR was registered on 17th January 2018. The prosecution case is that the accused had assaulted the victim on 16th January 2018. The names of applicants were not referred to in the FIR. However, in the supplementary statement the applicants' names have been reflected alleging that they have assaulted the victim by fist blows. The role of having assaulted by weapon is attributed to other accused. 2.

The applicants are arrested on 17th January 2019. The coaccused Samina Khatun Imran had preferred application for

2 of 2 29.BA.230.2019.doc anticipatory bail before this Court. It was allowed vide order dated 16th January 2019. Apparently role attributed to the said accused and the applicant is similar.

Considering the aforesaid circumstances, case for grant of bail is made out. 3.

Hence, I pass following order :

ORDER

(i) Criminal Bail Application No.230 of 2019 is allowed and disposed off;

(ii) The applicants are directed to be released on bail in connection with CR No.36 of 2018 registered with Powai Police Station, on furnishing PR bond in the sum of Rs.20,000/- each with one or more sureties in the like amount;

(iii) The applicant shall report Powai Police Station one in every fortnight on Saturday between 11 am to 1 pm till filing of charge sheet and thereafter once in a month on every first Saturday between 11 am and 1 pm till further orders;

(iv) The applicants shall not tamper with evidence and shall attend the Trial Court proceedings regularly, unless exempted by the Trial Court for some reason.
