In Crime No. 195 of 2018 for an offence punishable under Sections 307, 498-A, 323, 504, 506 read with Section 34 of the Indian Penal Code, the Applicant is seeking pre-arrest bail. 2.
Apart from unexplained delay of 13 days in lodging First Information Report immediately after the alleged incident, the victim has not complained to anybody as regards the incident in question of setting her ablaze, either against the Applicant or his family members. In the first statement to the Investigating Officer the victim does not speak of the
2/3 Yadav 913.aba.191.19 story narrated in the FIR. There appears to be matrimonial discord. As such, false implication cannot be ruled out. There are no criminal antecedents against the Applicant who is a public servant. 3.
In view of above, a case for grant of pre-arrest bail is made out. Hence, the following order.
ORDER
(A) In the event of arrest in Crime No. 195 of 2018 for an offence punishable under Sections 307, 498-A, 323, 504, 506 read with Section 34 of the Indian Penal Code, the Applicant be released on executing PR Bond of Rs.15,000/- with one or more sureties in the like amount.
(B) The Applicant shall attend the Investigating Officer on 28th & 31st January 2019 and 6th & 8th February 2019 between 10.00 a. m. to 12.00 noon and thereafter as and when directed by the Investigating Officer.
(C) The Applicant shall co-operate with the investigation. (D) The Applicant shall neither tamper the evidence of prosecution nor influence the prosecution witnesses.
