This is an application under Section 439 of Code of Criminal Procedure for bail.

The applicant came to be arrested in Crime No. 150 of 2019 registered at Bhosari Police Station, District Pune, for the ofences punishable under Sections 302, 307, 143, 147, 148, 149 of the Indian Penal Code (IPC), Section 4 read with 25 of the Arms Act, 1959 and Sections 37(1)(3) and 135 of the Mumbai Police Act, 1951.

I have heard the learned counsel for the applicant and the learned APP for the respondent - State.

According to the prosecution, on the date of the alleged incident i.e. 4 February 2019, present applicant and other coaccused assaulted the deceased by koyta and sticks on account of previous enmity and committed his murder.

The bail is sought on the ground of parity.

There are in all eight accused and six have been granted bail. I have perused the charge sheet. The motive of the alleged crime is attributed to the co-accused Ravi Manjrekar. The role attributed to the present applicant and other co-accused to whom bail is granted, appears to be identical. Considering these facts, I am inclined to release the applicant on bail. In the result, the following order is passed.

O R D E R

A] Application is allowed.

B] The applicant- Rohit Bhimrav Manjarekar be released on bail, in C.R. No. 150 of 2019 registered at Bhosari Police Station, District Pune, for the ofences punishable under Sections 302, 307, 143, 147, 148, 149 of the IPC, Section 4 read with 25 of the Arms Act, 1959 and Sections 37(1)(3) and 135 of the Mumbai Police Act, 1951, on furnishing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.
