DATE: FEBRUARY 12, 2020 P.C.:- 1] Learned Counsel for the Petitioner would urge that Respondenthusband is presently working in USA and is earning amount 5 lakhs ₹ per month. According to her, Court below has committed an error in recording finding that Petitioner has suppressed her source of income, so also quantum. She would try to rely on certain documentary evidence which is produced alongwith the Petition on record. 2] Perused the documents which are placed on record including bank statements of the Petitioner.

(37) wp-2644-19.doc 3] The observation made in the impugned order by the learned Court below speaks of independent source of income of the Petitioner as reflected in her income tax returns, banks statements etc. 4] In the aforesaid backdrop, rejection of prayer for grant of maintenance pendente lite under Section 24 of the Hindu Marriage Act is very much justified.

5] As claim of the parties can be properly gone into in pending proceedings, without prejudice to the observations made in the order impugned, in my opinion, no interference is called for in extraordinary jurisdiction. Petition fails and same stands dismissed. ( NITIN W. SAMBRE, J. ) 2/2
