The applicant is seeking anticipatory bail in C.R. No. 291 of 2019 registered with Barshi Taluka Police Station, Dist. Solapur Rural for offences punishable under Section 353, 323, 504 & 506 r/w Section 34 of Indian Penal Code.

The complainant is employee with MSEDC, Agalgaon. The energy bill was not paid on account of arrears. The complainant has visited the house of the accused for disconnecting the electricity. At that time son of the applicant had assaulted the complainant by fist and kick blows. The applicant had thereafter arrived at the place of incident abused and intimidated the complainant. 3.

Learned Counsel for the applicant submitted that the arrears of

2 of 3 915-ABA-264-2020.doc electricity department were cleared. Role attributed to the applicant is that he had abused and threatened. Custodial interrogation is not necessary.

Considering the facts, the applicant need not be subjected to custodial interrogation. He can be directed to cooperate with the investigation.

Hence, I pass the following order :

O R D E R

i) Anticipatory Bail Application No.264 of 2020 is allowed;

ii) In the event of arrest of applicant in C.R. No. 291 of 2019 registered with Barshi Taluka Police Station, Dist. Solapur Rural, the applicant be released on bail on furnishing P. R. Bond in the sum of Rs. 25000/-, with one or more sureties in the like amount;

iii) The applicant shall attend Investigating Officer on 5th & 6th February, 2020 between 11.00 a.m. to 1.00 p.m. and thereafter as and when called for till filing of charge-sheet.

iv) Anticipatory Bail Application stands disposed of accordingly.
