Heard the learned Counsel for the applicant and the learned APP for State.

It is a matter of record that previous application filed by the present applicant i.e. Criminal Bail Application No. 2497 of 2016 was rejected by a reasoned order dated 24/1/2017. The applicant had once again approached this Court by filing Criminal Bail Application No. 1411 of 2017 which was withdrawn on 6/10/2017.

Learned Counsel for the applicant vehemently submits that the applicant is young and that there were certain aspects which were not demonstrated before the court such as the fact that the applicant Talwalkar

1.ba216.18.doc was in love with Ms. X, who happens to be the victim. However, the same cannot be taken into consideration at this stage, as that may be a defence of the accused at the time of trial. It is further submitted that the applicant is in custody since 12/6/2016. However, till today, charges are not framed.

Taking into consideration the fact that the applicant has been in custody for almost 2 years, the Special Court(POCSO), Dindoshi is hereby requested to make an endeavour to expedite the trial and as far as possible conclude recording of evidence by 30/1/2019.
