By this First Appeal, the appellant/original claimant is challenging the judgment and award dated 20/04/2016, passed by Railway Claims Tribunals, Mumbai Bench, Mumbai in Claim Application No.OA(IIU)/MCC/2010/0122 rejecting appellants' claim application under Section 16(1) r/w Section 13 (1-A) of the Railway Claims Tribunal Act, 1987, and Section 124-A of the Railways Act, 1989, seeking compensation to the tune of Rs.4,00,000/-. 3.

Considering the submission made by the learned counsel for appellants and the impugned judgment and award, the following order is passed - H.R.Shinde

Fa 784-2017 (i) Admit.

(ii) Printing dispensed with.

(iii) The appellant to fle private paper-book with copy to other side within one year from today, failing which the First Appeal shall stand dismissed without further reference to the Court.

(iv) The Registry is directed to call R & P immediately. (v) Advocate Mr.Navin Bagul waives service for respondent. (vi) Hearing of First Appeal is expedited.

(vii) Liberty granted to the appellants to move for fxing earlier date of hearing after fling private paper book and receipt of R & P.
