The mother and brother of the petitioner have filed Special Civil Suit No. 668 of 2016 in the Court of Civil Judge, S.D., Pune. The petitioner is one of the defendants in the said Suit. Prayer clauses (i) & (j) in the Plaint refer to the Development Rights Certificates (DRC).

We have perused the copy of the plaint and the prayers made in the present petition. Considering the nature of reliefs sought in the above Special Civil Suit and the present petition as well as the parties contesting both the matters, we find that the petitioner's issue would be adjudicated in the said Special Civil Suit on its own merits. 3.
