1] By an Order dated 10 th February 2016, the applicant was granted interim relief.

2] Heard the learned Counsel for the applicant and the learned APP. Perused the record of investigation.

3] It is the contention of the learned Counsel for the applicant that the present crime is registered on similar set of facts which are involved in CR No.215 of 2013 registered with Govandi Police Station on 4.9.2013and therefore this Court by an Order dated 17 th November 2016 had directed 1/2

aba.133-2016.doc the Joint Commissioner of Police, Economic Offence Wing to look into the matter and to take appropriate steps in that behalf. 4] In pursuance of the said direction on 27 th June 2017 the concerned APP intimated this Court that the investigation of both the crimes will be carried out by Economic Offences Wing. The said statement was recorded in Order dated 27 th June 2017. By the said Order, the applicant was directed to report to the Economic Offence Wing on stipulated dates. The record indicates that the applicant attended the concerned Investigating Agency and cooperated in the process of investigation.

5] In view of the peculiar facts of the present case, interim relief granted by an Order dated 10 th February 2016 is confirmed. However, the condition to attend the Investigating Agency is hereby waived. 6] Both the applications are allowed in the aforesaid terms. (A.S.GADKARI, J.) 2/2
