Heard. This Application is made by the Plaintiff for an order of injunction restraining the Respondent No.1 from carrying out any construction and/or further encroachment over the suit property.

The learned counsel for the Respondent No.1 submits that he received instructions from his client to make a statement that, henceforth the respondents do not want to carry out any construction on the suit property and also they will not encroach upon the suit property, till hearing and final disposal of the Second Appeal. Statement is accepted.

In view of the said statement, nothing survives in the Civil Application. Same stands dismissed as infructuous.
