The applicant is apprehending arrest in connection with CR No.9 of 2020 registered with Vadgaon Nimbalkar Police Station, District Pune, for offences under Sections 39 and 45 of Maharashtra Money Lending Act, 2014.

The case of the complainant is that the accused is indulging in money lending activities without requisite license. The complainant had obtained loan of Rs.5 lakh. The accused under coercion harassed him to pay interest from time to time and thereby the complainant had paid Rs.29 lakhs.

Learned APP, on instructions of the officer who is present in the Court, submits that the voice recording of the complainant and the applicant was recorded for which voice sample of the applicant is required to be obtained and hence he may be directed to attend the investigating officer.

Considering the aforesaid circumstances, the applicant is directed to attend the investigating officer and co-operate with the investigation. Hence, I pass following order :

ORDER

(i) In the event of arrest of applicant in connection with CR No.9 of 2020 registered with Vadgaon Nimbalkar Police Station, District Pune, the applicant be released on bail on furnishing PR bond in the sum of Rs.25,000/- with one or more sureties in the like amount; (ii) The applicant shall attend the Investigating Officer on 10th, 11th and 12th February 2020 between 11 am and 1 pm, and thereafter as and when called for till filing of charge sheet; (iii) The applicant shall not threaten the complainant and his family;

(iv) ABA No.272 of 2020 is disposed of in above terms. (PRAKASH D. NAIK, J.) MST
