By this Civil Application, Applicant original defendant is seeking condonation of 20 days delay in filing First Appeal challenging the judgment and order dated 1st September 2016 passed by the City Civil Court, Mumbai in S.C.SuitNo. 7539 of 2003 (H.C.Suit No.4045 of 2003).

Considering the submissions made by the learned Counsel for the Applicant and averments made in Civil Application, I am satisfied that Applicant has made out a case for

Hence, the following order is passed:

a) Delay in filing First Appeal, is condoned.

b) Civil Application stands disposed of accordingly. No order as to costs.
