1] At the outset, the learned APP submitted that, the trial arising out of C.R. No.I-131 of 2017 registered with Bazarpeth Police Station, Kalyan, District-Thane has already commenced and the prosecution has examined two witnesses. She further on instructions submitted that, the prosecution may further examine five to six witnesses in support of its case 1/2

ba.227-2018.doc and the said case may be concluded within a period of four months from today.

2] In view thereof, the learned Counsel for the respective applicants on instructions seeks leave to withdraw the present applications with liberty to file a fresh application for bail before the Trial Court in the event if the trial arising out of C.R. I-131 of 2017 does not conclude within a period of six months from today.

Leave and liberty granted.

3] Both applications are dismissed as withdrawn with aforesaid liberty.
