By this Civil Application, the applicant is seeking condonation of 88 days delay in filing First Appeal challenging the Judgment and Decree dated 1st September 2016 passed by the City Civil Court, Mumbai in Suit No.7846 of 2004 (H.C.Suit No.55 of 2004).

Considering the submissions made by the learned counsel for the applicant and the averments made in Civil Application, I am satisfied that Applicant has made out a case for
