1] Heard learned counsel for the Petitioners as well as learned AGP for the State. Learned counsel for the Petitioners prays for a direction to the Collector, Kolhapur to dispose off Miscellaneous Application No.9 of 2007 in accordance with law.

2] In view of the nature of the prayer made in the Writ Petition, no purpose will be served by issuing notice to the Respondents, since no right of any of the parties is being adjudicated herein. Hence, with the consent of both the parties, we dispose off the Writ Petition with a direction to the Collector, Kolhapur, to take up Miscellaneous 1/2

(2)WP-3879-19.doc Application No.9 of 2007 (Exhibit B) and dispose off the same preferably within a period of six months from today. Nothing stated herein shall influence the Collector, Kolhapur while deciding the application. The parties are at liberty to raise such contentions, as may be advised. Learned Collector, Kolhapur, shall do well to decide the application strictly in accordance with law.
