On behalf of the respondent/State, affidavit sworn by Mr.Sanjeev Phulpagare, Assistant Police Inspector, Economic Offences Wing, Unit - VII, Mumbai, has been filed. Paragraph 11 of that affidavit reads thus :

"11 I say that thus the statement of the Applicant Mr.Sanjeeva Sood, statement of Mr.Rajendra Ranmale Investigating Officer, statement of Anil Gupta, deposition of Anil Gupta before the Special Court, MPID, Mumbai and the FIR clearly indicates that the name of Mr.Anil Gupta at Sr. no.14 in the list of Investors has been wrongly mentioned and there is no investment under the name of Mr. Anil Gupta in the Company Noel Pharmaceuticals and thus the name of Mr. Anil Gupta should be deleted from the said list and the name of the Applicant Mr.Sanjeeva Sood should be added to the said list of Investors."

In view of this affidavit, name of Mr.Anil Gupta be deleted from the list and name of the applicant Mr.Sanjeeva Sood be substituted in his place.

The application is accordingly disposed of.

The Registry to do the needful accordingly.
