Mr. Shah, learned counsel for the petitioner, seeks leave to withdraw the petition with liberty to file an application for discharge in the trial Court. Leave with liberty as prayed for, is granted. The writ petition stands dismissed as withdrawn.

In the event, discharge application is preferred by the petitioner within a period of three weeks from today, the same shall be disposed of as expeditiously as possible and preferably within a period of six months from the date of filing of the same.

Mr. Shah, learned counsel for the petitioner submits that the petitioner is residing at USA and his presence before the trial Court may Shubhada S Kadam 1/2

Sr.No.27 WP 348.15 be dispensed with. The petitioner, in this regard, can file an application for exemption before the trial Court. In the event, such an application is filed, the trial Court shall consider the same sympathetically on its own merit.
