1] The learned APP on instructions submitted that in pursuance of order dated 25.1.2016, the applicant has attended the Investigating Officer and has co-operated during the process of investigation. She further on instructions submitted that the medical test of the applicant is to be conducted as the offence under Section 376 of IPC has been applied to the present crime, in view of the supplementary statement of the complainant. She further on instructions submitted that the custodial interrogation of the applicant is not necessary.

2] In view of the same, interim relief granted by an order dated 25.1.2016 is hereby confirmed. However, the applicant is hereby directed to attend the Investigating Officer as and when called for between 11.00 a.m. to 1.00 p.m. and to join the process of investigation till filing of final report.

Dond 2/2 aba.137-2016.sxw 3] It is needless to mention that before calling the applicant to the Police Station, the Investigating officer shall issue notice under Section 160 of Cr. P.C.
