By this application, the applicant seeks return of his pass-port which is deposited with the Versova Police Station in connection with CR No.334 of 2014 and to permit him to travel to Bankkog from 06-02-2016 to 08-02-2016.

By an order dated 15th January 2015 the applicant was directed to deposit his passport with the Investigating Officer. The learned counsel for the applicant submits that the applicant intends to travel abroad for the purpose of his N.S. Kamble page 1 of 3

business transaction to Bankkog. She further submitted that the applicant is ready and willing to abide by all the conditions which are to be imposed by this Court.

The learned APP on instructions submitted that in the present case the charge has already been framed and witness summons are issued by the Trial Court and the next date of hearing is 18-02-2016.

In view of the above the following order.

ORDER

(i) The police from Varsova Police Station are hereby directed to handover the pass-port to the applicant on 05-022016 for a period of five days. (ii) The applicant is permitted to travel to Bankkog between 06th February 2016 to 08th February 2016. (iii) The applicant on its return shall deposit the passport with the Investigating Officer on or before 10th February 2016.

(iv) The applicant shall before leaving India file an undertaking before the Trial Court that he will surrender the pass-port before the Investigating Officer on or before N.S. Kamble page 2 of 3

10.2.2016. The said undertaking should be filed before leaving India.
