1] Heard Mr.Marwadi for applicant and Mr.More, learned APP for State. Though the applicant has filed an affidavit to deposit the amount of Rs.35 lakhs within a period of four months from the date of affidavit, he has not been able to do so till today. The affidavit was filed in August 2014.

2] The direction given to the applicant to deposit Rs.35 lakhs was one of the conditions of bail granted to the applicant in a case where he is facing charges for the offences punishable under section

YBG appw39-15 120(B), 255, 259, 260, 467, 468 and 471 read with 354 of IPC. The applicant has so far deposited Rs.13 lakhs in trial court. As such, the balance amount to be deposited by the applicant comes to Rs.22 lakhs. The applicant prays time of two months to pay this amount. He is staying at a house in Koparkhairane, Navi Mumbai and his house which is under construction, is put up for sale by the applicant. In the circumstances, I modify the order as under:- (a) The balance amount of Rs.22 lakhs shall be deposited by the applicant in trial court in two instalments of Rs.11 lakhs each on or before 10th April 2015. If the amount is not deposited by the applicant in the trial court, the trial court shall take immediate steps for arrest fo the applicant. The application is disposed of accordingly.
