This is an application for releasing the applicant/accused on bail during pendency of the appeal filed by him.

The applicant/appellant/accused is convicted of the offences punishable under Section 8(c) read with Section 20(c) as well as under Section 8(c) read with Section 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 and on each count, he has been sentenced to suffer rigorous imprisonment for ten years apart from imposition of fine of Rs.One Lakh on each count. Perused the impugned Judgment and Order of conviction as well as the resultant sentence. The only ground which is urged for getting the applicant/accused released on bail is that the appeal is of the year 2013 and has not been heard for more than five years. The appeal is overdue for hearing. It is seen that the applicant/accused is behind bar right from the year 2012. In this view of the matter, the application is disposed of with a direction that the appeal be added to the board of final hearing from the week commencing from 20th February 2018. (A.M.BADAR J.)
