Challenge in this petition is to the order dated 3rd September, 2021 passed by Judicial Magistrate First Class, Alibaug in Criminal Complaint No.256 of 2021 lodged with Mandva Sagar Police Station under Section 507 of the Indian Penal Code, 1860 and consequential Criminal Complaint No.256 of 2021. 2.

Learned APP has placed on record copy of communication issued by Investigating Officer to the Chief Judicial Magistrate, Alibaug informing that no material is available against the persons against whom the complaint was filed and, therefore, request for acceptance of C-Summary is made.

The Judicial Magistrate First Class on 23rd March, 2023 has issued notice to the complainant.

In that view of the matter, nothing remains to be adjudicated in the present writ petition. However, in case the Magistrate refuses to accept C-Summary liberty granted to the petitioner to revived this Writ Petition.

The Writ Petition stands disposed of in the above terms. No costs.
