The applicant is arrested on 19th September 2019 in connection with C.R.No.I-536/2019 registered with Narpoli Police Station, Bhivandi, Dist. Thane for offences punishable under Sections 304-B read with 34 of Indian Penal Code.

The First Information Report (in short F.I.R.) was lodged by the mother of the deceased. The applicant is father-in-law of the deceased. The mother-in-law was arrested and she has been granted bail.

According to complainant, the marriage of her daughter

(deceased) was performed on 12th May 2019 with accused No.1. There was no demand of dowry in the marriage. However, after few months, husband of the victim had called the complainant and told her that the property in the name of victim be sold and the amount be given to him as he wants to purchase gold ring and motorcycle for his brother. The complainant refused to fulfill his demand. 4.

It is further alleged that in August 2019, the victim had visited her parental home. She told the complainant that her father-in-law (applicant) and others are harassing and insisting to sell agricultural land and in the event, it is not done, she would be thrown out of the house. On 17th September 2019, she committed suicide. The husband of the deceased is also arrested.

Learned Counsel for the applicant submitted that the statements of witnesses are contrary to the version of the complainant with regards to demand of money. The applicant is Senior Citizen aged about 62 years. Chargesheet is filed. He is in custody for 18 months.

Learned APP submitted that the incident had occurred within a short span of time after the marriage. The applicant and others were continuously harassing the victim and compelled her to commit

suicide.

The applicant is in custody for a period of about one and half year. Investigation is complete and the chargesheet is filed. The applicant is aged about 62 years. Further detention is not necessary. Bail can be granted.

Hence, I pass following order.

O R D E R

(i) Bail Application No.471 of 2021 is allowed.

(ii) The applicant is directed to be released on bail in C.R.No.I-536/2019 registered with Narpoli Police Station, Bhivandi, Dist. Thane, on executing P.R. bond in the sum of Rs.25,000/- with one or more sureties in the like amount;

(iii) Bail Application No.471 of 2021 stands disposed of accordingly.
