None appears for the petitioner.

The petitioner, allegedly defrauded MMRDA in the matter of obtaining financial assistance from the Dena Bank with whom the MMRDA has made fixed deposits.

It appears that at the behest of Dena Bank an independent FIR/offence is registered against the petitioner. As such, the petitioner has preferred the present petition alleging that the petitioner cannot be prosecuted twice for the very same offence. BGP.

Considering the trial in the offence has already commenced as is informed by learned APP on instructions from the Senior Inspector of Police, Economic Offences Wing, Commissionerate of Police, Mumbai, in our opinion, the petition does not deserve any interference.

The petition as such stands dismissed.
