Heard Mr. Dushyant Pagare, learned counsel for the applicants.

By this petition, the applicants have sought extension of three months time to deposit amount of Rs. 8,30,000/- as directed by order dated 11.12.2015 passed by this Court in Writ Petition No.12210 of 20915. By that order, the petition instituted by original defendants challenging the judgment and order dated 27.10.2015 passed by the learned Judge, City Civil Court, Bombay in Summons for Judgment No.585 of 2014

2/2 CAW/255/2016 in Summary Suit No. 3316 of 2012 (High Court Summary Suit No.1197 of 2012), was rejected. While rejecting the petition, at the request made by the petitioners' Advocate, six weeks time for depositing the amount of Rs. 8,30,000/- was granted. The applicants are now seeking three months extension of time.

It is not possible to accept to the request.

In view thereof, Mr Pagare seeks extension of one month's time for depositing the amount of Rs.8,30,000/- in the trial Court. He further assures that the applicants will not apply for extension of time.

In view thereof, time to deposit amount of Rs.8,30,000/- in the trial Court is extended upto and inclusive of 9.3.2016. The applicants shall not apply for further extension of time. Civil application is disposed of accordingly with no order as to costs.
