This is an application under Section 439 of the Cr.P.C. for bail in CR No. 301/2017 dated 9.7.2017 registered with MIDC Police Station, Mumbai under Sections- 406, 409, 465, 467.468, 471, 472, 474 and 120B of the Indian Penal Code.

Heard the learned counsel for the applicant and the learned APP. for the State. Perused the record. 3.
It is the prosecution case in brief that that co-accused Chanchal Palav gave RTGS form filled in the name of M/s. Shiv Samruddhi Developers to the applicant for submitting
2 /3 it with Punjab & Maharashtra Co-op. Bank Ltd. That, the said amount was thereafter transferred in the name of M/s. Aaditya Granites. That, the applicant received the said amount of Rs.1,50,000/- for doing the needful. The role of the applicant has come on record in the statement of co-accused Chanchl Palav so also in discovery panchanama recorded under Section 27 of the Evidence Act wherein, at the instance of the applicant recovery of Rs.22,000/- has been effected. Apart from that, prima facie, it appears that there is no other material against the applicant.

In view thereof, the applicant can be released on bail. Hence, the following order.
a) The applicant be released on bail in CR No. 301/2017 dated 9.7.2017 registered with MIDC Police Station, Mumbai on his furnishing PR bond of Rs.25,000/- with one or two solvent local sureties in the like amount. b) After his release from Jail, the applicant shall attend the concerned Police Station on every first Monday of the month between 11.00 a.m. to 1.00 p.m.
3 /3 c) The applicant shall attend all the dates before the Trial Court unless precluded on medical reasons. d) The applicant shall not tamper with the evidence and/or pressurize the prosecution witnesses.
