Learned Counsel for the applicant-original complainant seeks cancellation of bail of respondent No.3-Amar Kumar Chanak on the ground that the said respondent had threatened the witness viz. Adhir Ghorai, resident of Kolkata. The said Adhir Ghorai is also said to have lodged First Information Report against Amar Kumar Chanak with Baranagar Police Station, Kolkata. 29-IA-819-2024.doc Learned Counsel for respondent No.3- Amar Kumar Chanak, however, invites my attention to the copy of the said FIR dated 1st January, 2024 which does not reveal the name of respondent No.3. Prima facie, the submission made by the complainant appears to be false.

It is informed by learned Counsel for respondent No.3 that an FIR alleged to have been lodged with Baranagar Police Station is in respect of co-accused Anil Maji and Prabir Maity. A copy of the CCTV footage relied upon by learned Counsel for the applicant at page Nos. 135 to 139 even does not clearly depict the person being respondent No.3.

Learned Counsel for the applicant-original complainant, therefore, seeks to withdraw the application. Application stands dismissed as withdrawn.
