By this application filed under section 11(6) of the Arbitration and Conciliation Act, 1996 the applicant seeks appointment of the arbitral tribunal in terms of the arbitration agreement entered into between the parties. There is no dispute about the existence of the arbitration agreement. 2.

Pursuant to the order dated 4th May, 2016 passed by this court, learned counsel appearing for the petitioner has tendered a statement of disclosure dated 6th May, 2016 filed by Mr.Shubhash Govind Pingle who is nominated by the petitioner as an arbitrator.

Learned counsel appearing for the respondent has filed statement of disclosure dated 16th June, 2016 filed by Mr.M.V. Patil as nominee arbitrator on behalf of the respondent. Statement of disclosure filed by the learned arbitrators are taken on record and are accepted. Mr.Shubhash Govind Pingle is appointed as a nominee arbitrator on behalf of the petitioner. Mr.M.V. Patil is appointed as a nominee arbitrator on behalf of the respondent. Both the learned arbitrators

kvm 2/2 6-ARP12.15 nominated by the parties and appointed by this court are directed to appoint the presiding arbitrator in accordance with the provisions of Arbitration and Conciliation Act and constitute a arbitral tribunal. 4.

Arbitration petition No.12 of 2015 is disposed of in the aforesaid terms. No order as to costs.
