spb/ 907revn44-14appr44-15.doc I have gone through the evidence of three eye witnesses including the complainant. The evidence needs little closure scrutiny as there is no cross-examination of the witnesses in the trial court. It is also possible that the court may consider to remand the case back to the trial court for recording examination, if any. Keeping these possible views in the matter, it is just and proper that the Applicant is released on bail.
Hence, the Applicant be released on bail in sum of Rs.15,000/- with one solvent surety in the like amount or on a cash deposit of Rs. 15,000/- in lieu of the surety. Substantive sentences imposed on the Applicant shall remain suspended during the pendency of the revision application.
Criminal Application stands disposed of.
