Heard learned counsel for the parties.

By this Application, the Applicant seeks her enlargement on bail in connection with C. R. No. I-61 of 2015 registered with the Vikramgad Police Station, District - Palghar, for the alleged offence punishable under Section 302 r/w 34 of the Indian Penal Code. 3.

Perused the papers. According to the prosecution, the incident took place on 01.07.2015 at around 5.30 p. m.. According to the eye witnesses, Leela was assaulted by the Applicant and her husband - Manik Batra. Eye witnesses have alleged that the Applicant, a lady, was

BA 237-18.doc assaulting Leela with fist and kick blows and the Applicant's husband was assaulting Leela with a wooden log. The cause of death is stated to be 'due to intra cranial bleeding. Secondary to head injury'. Investigation is complete & charge-sheet is filed. The Applicant is in custody since 23.06.2017.

Considering the Applicant's role, the Application is allowed and the Applicant is enlarged on bail on the following terms & conditions :-

O R D E R

(i) The Applicant be enlarged on bail, on executing PR Bond in the sum of Rs. 10,000/- with one or two sureties in the like amount; (ii) The Applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case;

(iii) The Applicant to cooperate in the conduct of the trial. 5.

The Application is allowed in the aforesaid terms and is accordingly disposed of.
