Learned APP points out that the matter arises out of the proceedings under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act and therefore, the Anticipatory Bail Application may not be maintainable.

Faced with this, the learned counsel for the Applicant, on instructions, seeks leave to withdraw the Application, with leave to challenge the said order in an Appeal. He also requests for extension Mamta Kale page 1 of 2
44-aba-245-2022.doc of interim protection for a period of two weeks, in order to enable the Applicant to file an Appeal.

In such circumstances, the Criminal Application is disposed of, as withdrawn, with liberty as prayed.
