This is an application under Section 438 of the Code of Criminal Procedure for anticipatory bail.

The applicant is apprehending his arrest in Crime No. I-434 of 2022 registered at Sinnar Police Station, Nashik for the offences punishable under Sections 307, 324, 323, 504, 506, 143, 144, 147, 148, 149 of Indian Penal Code, 1860 and Sections 37(1)(c), 135 of The Maharashtra Police Act, 1951.

The bail is sought on the ground of parity. In support of the said ground the learned counsel for the applicant has placed on record copy of the order passed by this court dated 19 January 2023 in ABA No.3193 of 2022.

I have perused the order passed by this Court dated 19 January 2023 in ABA No.3193 OF 2022. The role attributed to the applicants therein and the present applicant appears to be identical. For the reasons stated in the said order, I am inclined to release the applicant on anticipatory bail. 5.

In the result, following order is passed;

ORDER

(a)In the event of arrest of the Applicant in C.R. No.I-434 of 2022 registered at Sinner Police Station, he shall be released on bail on furnishing P.R. bond in the sum of Rs.20,000/-(Rupees Twenty Thousand only) with one or two sureties in the like amount ;

(b) The Applicant shall report to the Investigating Officer as and when required by the Investigating Officer. (c)Anticipatory Bail Application stands disposed of. ( N.R. BORKAR, J. ) 2 / 2
