This Application is preferred by the plaintiff for carrying out appropriate amendment in Appeal from Order no. 1137 of 2014.

Office note shows that till today the Appeal from Order is not admitted by this court.

18 caa 121-15=.doc Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for allowing the present Civil Application. Hence, the Civil Application is allowed in terms of prayer clause (a) which read thus:

"a) That this Hon'ble Court be pleased to permit the Appellant to amend the appeal memo and carry out other incidental and consequential amendment in terms of schedule annexed to this application."

Applicant to carry out appropriate amendment within four weeks from today, failing which the Civil Application shall stand dismissed without further reference to the court.

If amendment is carried out within stipulated time as stated hereinabove, applicant is directed to serve the amended copy of Appeal memo on respondent's within two weeks thereafter.
