Kishor Baburao Patil v. The State Of Maharashtra
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CRIMINAL APPELLATE JURISDICTION ANTICIPATORY BAIL APPLICATION NO.136 OF 2015 Kishor Baburao Patil ...Applicant vs.
State of Maharashtra
...Respondent
Mr. Prakash Naik i/b. Mr. S.L. Babar, Advocate for the Applicant.
Mrs. A.A. Mane, APP for the State.
CORAM : P.D. KODE, J.
DATE : JANUARY 30, 2015 P.C.
.
At the hearing of the application, the learned counsel for the applicant submitted that instead of pressing an application for pre arrest bail, he is making limited request for granting reasonable time to the applicant to surrender before the trial Court and pray for bail and in the meanwhile protecting him on the conditions deemed fit and proper by this Court and giving appropriate direction to the learned Magistrate to decide the 1/3
application for bail at the earliest preferably on the same day and in the meanwhile continuing the protection granted to them by the Court of Session. 2.
Request being made for surrendering before the Court of Law which would facilitate earlier completion of investigation of crime in question, request deserves consideration. The request for continuing protection also deserves consideration as the order passed by the Court of Session does not reveal that the applicant having breached the conditions imposed while granting it.
3.
Resultantly, the application stands disposed of as withdrawn.
4.
As informed the applicant to surrender before the trial/remand Court on or before 05-022015 by 11.00 a.m. The protection granted by the Court of Session uptil 02-02-2015 to continue uptil 2/3
05-02-2015 by 11.00 am on the same terms and conditions.
5.
The trial Court to decide the application for bail if preferred by the applicant after his surrender as expeditiously as possible and preferably on the same day subject to 24 hours advance copy of the same being served upon the other side.
Application stands disposed of.
