This petition has been listed on account of the Sole Arbitrator appointed vide order dated 12th March, 2020 declining to act as such. Both learned counsel today state that the name of the Arbitrator be substituted with any one from the panel of Arbitrator and Conciliators maintained on the panel of this Court. Accordingly Dr. Shashikant Murlidhar Deshpande, Flat no. G-13, Rohan Garden Co-op Hsg. Society, S. No. 54/2/1 & 2, Kothrud, Pune-411 038 shall act as the Sole 1/2 5-arp-31-2020.odt rrpillai

Arbitrator in place and stead of Shri Chandrashekhar Sadashiv Modak, Accordingly, I pass the following order :

(i) By consent Dr Shashikant Murlidhar Deshpande is appointed Sole Arbitrator to adjudicate upon disputes between the parties. (ii) A copy of this order will be communicated to the learned Sole Arbitrator by the Advocates for the Applicant within one week from the date this order is uploaded. In addition, within one week of this order being uploaded, the Registry will forward an ordinary copy of this order to the learned Sole Arbitrator.

(iii) The learned Sole Arbitrator is requested to forward the necessary statement of disclosure under Section 11(8) read with Section 12(1) of the Arbitration Act to the "Registrar (Judicial-I) of this Court at his earliest convenience before entering upon the reference to arbitration. Copies will be given to both sides.

(iv) Petition disposed in the above terms.

(v) No costs.
