Mr.Patil, the learned Assistant Government Pleader, states that in the First Appeals arising out of the acquisition of the land for the same project, 1 / 2
caf.748.2014+_41.doc this Court had directed the State Government to deposit the entire decretal amount in the Tribunal within a period of 16 weeks and permitted the claimants to withdraw the said amount after furnishing security to the satisfaction of the Reference Court. The learned AGP states that a similar order could be passed in this case also.
In view of the aforesaid, the impugned award is stayed on the condition that the State Government deposits the entire decretal amount in the Reference Court within a period of 16 weeks. The respondents are permitted to withdraw the amount after furnishing security for the entire amount to the satisfaction of the Reference Court. The respondents are free to seek modification of the order as a notice is not issued to them on the Civil Application.
Civil Applications stand disposed of.
